L’auteur tire parti d’un passage des Voyages de Gulliver sur les précédents judiciaires au XVIIIe siècle pour expliquer brièvement comment, en common law, la règle du précédent a évolué jusqu’à nos jours au Canada et pour commenter deux décisions récentes de la Cour suprême du Canada en matière fiscale à cet égard. The author quotes excerpts on the use of judicial precedents in the eighteenth century drawn from the book Gulliver’s Travels, to briefly explain how, in common law, the precedent rule has evolved to this day in Canada. She comments in this regard on two recent judgments of the Supreme Court of Canada in the area of taxation.
